    Terms and Conditions

    1. General

    1. 1. "You" and "Your" includes an applicant, corporation, individual, customer, or another type (s) of legal entity which has subscribed for Services
    2. 2. "We" "Alpha Televoice Ltd" means the parent company of "mactel.ca" or any of its affiliates or subsidiaries.
    3. “3. "Equipment" means any device, Unit, Equipment, or hardware used in conjunction with the Service(s) or used to access the service(s) or, including any ATA analog/digital phone or other hardware rental or rented by a customer from mactel.ca.
    4. 4. "The Service(s)" or "Service(s)” means the services rental by you from mactel.ca, as mentioned and presented in these terms and conditions

    2. Service(s)

    2.1 Service Limitations, Performance, and Availability mactel.ca DOES NOT WARRANT OR GUARANTEE THAT THE SERVICE(S) INSTALLED AT YOUR LOCATION, mactel.ca will not have any liability in case that the installation of the Service (s) is not completed or successful for any reason.

    2.1.1 mactel.ca does not warrant or guarantee that the Service(s) or the provided Equipment(s) will be compatible with your own Equipment, or other Equipment (s) and/or Service (s) offered to you by any third-parties. It will be your responsibility to ensure that your existing Service, software, or Equipment is compatible with the Service (s) provided by mactel.ca. mactel.ca DOES NOT WARRANT OR GUARANTEE THAT THE SERVICE(S) WILL BE UNINTERRUPTED OR ERROR-FREE. Interruptions might happen under these circumstances, which include but are not limited to: server upgrades, power outage, scheduled maintenance, construction, force majeure or malicious network attacks. By using the Service (s) provided by mactel.ca, you understand and agree to all risks which might happen with the use of the Service (s) under any high-risk conditions, in which damage or injury may result if an error occurs.

    2.1.2 mactel.ca does not warrant or guarantee that its voice call(s) will perform at the same quality throughput rate. Also, mactel.ca DOES NOT GUARANTEE PERFORMANCE. Service(s) are provided on a Best Efforts Basis. The quality of services is dependent on your Internet service.

    2.2 Service change

    2.2.1 The Service(s) may be changed, moved or upgraded provided that you request for those changes and the costs will be covered by you, which may include any upgrading, moving fee, downgrading and other charges/expenses required to complete the request for the same. You will be informed in advance from the service provider about the costs before any such changing/moving request is finalized. Note that it is always subjected to availability checks for any such changing request(s), and mactel.ca may reject it because of service availability or reliability.

    2.2.2The service fee may change (increase/ decrease) during the service period as mactel.ca does not offer any contract services. However, we will inform you, at least thirty calendar days written advance notice by any communication methods like email, letter, on your bill, announcing or posting the notice on our website. This notice will clearly mention the changes and provide an effective date for the same. mactel.ca reserves the right to make a change or modify your account.

    3. Emergency Services – 911 Dialing

    Please read the following contents very carefully, which outlines the limitations and differences between basic 911 Service (911) and traditional 911 services. By using the mactel.ca VoIP service, you understand, acknowledge and confirm that you are of legal age (18 years or above), and you agree to the terms and conditions as set out below. If you do not wish to agree with any of the terms, do not use the VoIP Service provided by mactel.ca. 3.1 Basic 911 Service and limitations: 3.1 Basic 911 Service and limitations:

    The 911 Service that mactel.ca provides is not same but different from the traditional 911 service. All 911 calls will be routed to a Public Safety Answering Point (PSAP), to which the caller has to verbally provide her/his location or address, and other information. The PSAP is operated by a third party, who will be responsible for connecting your call to the appropriate emergency department. In case if you are unable to communicate or speak, the emergency respondent may not be able to dispatch units to you, or may only dispatch units to your last registered location, so it is your responsibility to keep all information up to date. However, your registered information, such as phone number and address, may not be available to the emergency respondent. Hence, you should always be prepared to provide your phone number and address when making the call.

    If the call gets disconnected due to any reason, the respondent might not be able to call you back, hence you should re-dial 911 immediately.

    It must be noted that basic 911 services may not function properly under these following scenarios:

    3.1.1 Power outage or interruption

    3.1.2 Equipment failure, including phones, adapters, cables, wires, USBs, ATAs, ATAs

    3.1.2 Internet outage, interruption or congestion

    3.1.4 Blocked Ports or IP address by ISPs, either intentionally or inadvertently

    3.2 3.2 Disclaimer of Liability:

    The basic 911 emergency service mactel.ca provides is via third parties and is not controlled by mactel.ca. mactel.ca disclaims any and all responsibilities, liabilities for the actions or conducts of the local or national emergency response centre. Since the basic 911 calls are dependent on third parties to complete, mactel.ca disclaims any and all responsibilities arising from the damage caused by erroneous and incorrect completion of calls routed by related third parties or either mactel.ca not its employees, agents, or affiliated associations shall be held liable for the failure or incorrect routing of 911 calls.

    3.3 Informing Users:
    You are responsible for informing all household residents, guests, and other persons who may be present at the location where you utilize the Service offered by mactel.ca, the difference, and limitations between basic 911 services and traditional 911 services. The basic 911 notifications or sticker should be placed in a clearly visible spot to all potential users.

    3.4 Authorization of information release:
    You understand and confirm that we can disclose your name and address to any third-parties involved with providing E911 Dialing services to you, including, by way of illustration but not limited to call centers, call routers, and local emergency centers.

    3.5 Alternative 911 Access:
    If you have any objections or disagree with the limitations of basic 911 service, you should seek alternative means of accessing the traditional 911 service and discontinue the Service from mactel.ca. In such circumstances, you understand that it is your responsibility to purchase and maintain a service from a third party that offers access to traditional 911 service.

    3.6 Charges :
    MacTel has agreed with certain emergency communications districts to charge you via email to collect the bill amount imposed by them for your service to dial 911 emergency numbers. As a result, users will be charged $ 20 per 911 call. Such amounts are in addition to any billed amount or fees paid by you for the MacTel Services. You understand and agree that it is essential that you must pay such charges agreeable to the instructions included in any bills you receive. You also agree and understand that the emergency communications district in your region may attempt to collect any amounts from you directly for failure to pay this government-imposed charge. MacTel does not gain any profit or keep any margin from your 911 services bill, and the amounts we collect are transferred over to the appropriate government authority according to their requirements in a very transparent manner.

    4. Charges, Payment and Credit

    4.1 mactel.ca Services are pre-paid, and customers are required to pay prior to the commencement of the billing cycle of the Services subscribed for. mactel.ca Services are charged by the billing cycle of every thirty (30) calendar days.

    4.2 As adjusted by mactel.ca hereunder, the authorized billing amount will be deducted twenty one (21) days prior to the date due for next invoice. All kinds of invoices not contested in writing within the period of twenty-five (25) business days of receipt are considered as accepted by the customer as true and accurate.

    4.3 mactel.ca billing is paperless invoice; an email will be sent every billing cycle when the invoice is generated.

    4.4 If we do not receive a payment for the bill pending on your account by the specific payment date, it will be subjected to a late payment charge of 3.5% or $1.99 to your regular bill per month, whichever is higher. This late payment penalty charge will accrue on a daily basis and will be calculated and compounded monthly on the outstanding amount from the pending billing date on which it appears till the date we successfully receive that amount in full from your side. You also understand and agree that we reserve the right to charge any outstanding and unpaid amount, including any late payment charges, penalty charges on any pre-authorized payment methods linked on your account (e.g.; bank account, credit card withdrawal or any other payment modes).

    4.5 The first recurring payment for Service (s) is due on the first day of the billing cycle. It is mandatory for residential accounts to be paid through automatic payments such as credit cards or paid manually with debit cards via online banking. You agree to make the payment for all applicable monthly service rates, equipment rental/purchase fees, monthly recurring fees, installation fees, shipping fee, and other fees, amounts and other charges, if any, together with all kinds of applicable taxes, mentioned in these terms or notified to you when you purchased our service subscription, purchase/rent Equipment, or as otherwise identified to you by mactel.ca from time to time. mactel.ca will bill you monthly in advance, and you are liable for and shall pay mactel.ca when due on a monthly basis on all invoiced charges.

    4.6 If a customer requests extra Service or changes that require additional human capital, we may apply an additional service processing fee. Any residential account that is 1 day past due will be put on hold till the payment is completed. If a user account has been put on hold or suspended due to non-payment, no credit or refund will be issued for the days/period without Service. If the Service is suspended or terminated due to non-payment, there will be an additional $5 plus tax restoration fee for resuming your Service. User Accounts more than 5 days past due will be terminated with/without further notice and subject to appropriate collection fees. Resuming of Services shall include an installation fee where it is applicable.

    4.7 You must bring payment inquiries and disputes to mactel.ca's attention within 1 day after the Service charge has been paid, or you will be deemed to have accepted such charges as accurate in all respects.

    4.8 mactel.ca only begins counting credits by day(s) from when you call in, to the date that your issue is fixed. Any kinds of credit provided to you by mactel.ca will be classified as service credit and this service credit can only be used in the Service (s) that mactel.ca provides. This service credit cannot be refunded to credit card, cashed out, or utilized otherwise. The credits provided under certain conditions or offers such as annual plan can be charged back if the customers do not meet them.

    5. Chargeback

    5.1 Chargeback is a type of request that a customer submits directly with an issuing bank to invalidate or reverse a payment which has been processed. When a customer files a disputes and requests the reversal of payment to their bank for the charges that appears on their bill, mactel.ca will cooperate with your issuing bank for the chargeback investigation. mactel.ca reserves the right to terminate or suspend any kind of Service(s) or activities under your account until the investigation is completed and the case has been resolved between bank(s) and mactel.ca. mactel.ca reserve the right to charge a portion of the charge back processing fee.

    6. Equipment

    6.1 "Equipment" means any Equipment, device or hardware used to gain access to the Service (s), or has been used along with the Service (s), including hardware rental or rented from mactel.ca. Excluding the Equipment that you have fully paid for and no dues are pending, and you agree that all other Equipment provided or installed by us shall remain our property:

    6.1.1 You will take reasonable care with your own Equipment.

    6.1.2 You may not sell, lease, mortgage, transfer, assign or encumber your own Equipment.

    6.1.3 You will return Equipment to us at your own expense upon termination of the services to which the Equipment relates.

    6.2 If such Equipment is lost, stolen, tampered or damaged, or sold, leased, mortgaged, transferred, assigned, encumbered or otherwise not returned within the period of thirty (30) days of the cancellation date regarding your Service (s), you understand and agree to make the payment to us of the undiscounted retail value of such Equipment, along with any additional costs incurred by us while attempting and seeking possession of these Equipment. If your Equipment gets damaged, stolen, lost, or destroyed, you must inform us on an urgent basis by contacting our Customer Support (416-623-8003 or support@mactel.ca).

    6.3 If you choose to cancel your Service while the Equipment was under renting condition, the rental Equipment must be returned to mactel.ca. If not return in 30 days then which shall be charged to $95 in your account, if the returned rental Equipment(s) is/are in good working condition subject to normal wear and tear.

    6.4 You can choose to purchase the renting Equipment by paying the full listed price.

    6.5 Equipment Repair or Replacement
    mactel.ca will repair or replace any defective ATA rental by you, from mactel.ca, for one year from the date of your receipt such Equipment. mactel.ca reserves the right to make any changes, extension or modification of the length of this warranty period, taking into consideration of all the details and other information of the promotional campaign and the understanding agreed between the parties upon registration of Service (s).All warranties becomes void once customer's Service is terminated or cancelled. You can inform us by phone in case you have any issue with your ATA (the "Returned Equipment"). Once we confirm, you may ship your Returned Equipment to us for repair and examination, along with your ID number. This repairing and replacement process can take up to two weeks, and is as follows:

    6.5.1 You need to ship the Returned Equipment, packaged in bubble packaging in the ATA case, and in the original product packaging, including all items, accessories which were originally provided by the vendor or the manufacturer (including all manuals and accessories) in the case of ATAs, to mactel.ca at your own expense. We will inspect the Returned Equipment once the shipment is received by us.

    6.5.2 If the issue arose due to physical damage which mactel.ca reasonably determines whether you caused it. We will notify you and allow you to purchase or rent a replacement ATA or router. You will have to bear the charges for the Replacement Equipment, including shipping.

    6.5.3 If the Returned Equipment is in fact determined by mactel.ca to be faulty, in that case we will ship the Replacement Equipment to you, and you will need to send the Returned Equipment to mactel.ca at your own cost.

    6.5.4 If we find no issues with the Returned Equipment, and the equipment are working properly under our test conditions, we will charge 30 dollars as restocking fees.

    6.5.5 mactel.ca reserves the right to charge device fees if Equipment (s) are not received within 30 days after cancellation.

    6.6 Once you have informed us over phone, and we were not able to provide you a resolution for your issue through troubleshooting by normal means of communication with you, you may request for an immediate shipping of a Replacement unit before we have even received or tested your Returned unit. This way you can continue enjoying your Service without interruption during the return and review process which generally take up to two weeks. In this case the following applies:

    6.6.1 Once you have informed us over the phone that you are facing an issue with your Returned unit, we will immediately ship you the Replacement unit and charge your account for the Replacement cost Equipment and shipping. This charged amount will be refundable as provided below.

    6.6.2 You will be required to ship the Returned Equipment to mactel.ca at your own expense; once we receive we will test the Returned Equipment.

    6.6.3 If the issue arose due to physical damage, which mactel.ca reasonably determines that you caused it, we will inform you about the same without taking further measures or effort to fix the unit. You can keep the Replacement Equipment, which will be considered as bought and paid by you.

    6.6.4 If the Returned Equipment is in fact determined by mactel.ca to be faulty or not functioning properly, we will refund you the full amount which we charged.

    6.6.5 If no issues are found or detected with the returned Unit/Equipment, and if it performs properly under our test conditions, we will keep the Returned Equipment and refund you the Replacement Equipment cost minus the restocking fee of $30.

    6.7 The one-year period referred to above shall apply from the commencement date of Service (s), including both the original Equipment(s) rental, and any Replacement Unit(s), so that this provision will not be applicable or covered beyond the end of the first year following the purchase of the original Equipment. Please note that if you change the shipping address for the Equipment/Unit, after we have shipped the Equipment/Unit, under such circumstances we might need to reship the Equipment/Unit, this will result in additional $10 cost for this re-shipment.

    6.8 Your Equipment: It is your responsibility to ensure that your hardware meets the minimum requirements stated by mactel.ca as being necessary to use the Service. From time to time, the hardware might be needed to change or upgrade for keep using our services. Depending on the future updates your hardware might not be adequate to access and use the Service.

    7. Promotion

    7. Promotion 7.1 Any kind of offers or promotions involving a reduced or discounted price of any of the Service commences upon the initial receipt of the Service /Services by our customer and gets over on the last day of the period stipulated with respect to that particular Promotional offer. The user will be charged regular price for the relevant Service (s) for such Service as set out by mactel.ca or the charges will be on the line as communicated to the customer. The customer understands and agree that until unless it is specified and mentioned specifically by the service provider, a promotional offer is available for a limited time period only and may be terminated or changed at mactel.ca's sole discretion, although such termination or change shall not alter or affect the window period of the Promotional offer for which a customer/user has already understood and agreed to, that the customer is aware of all conditions under the premise with which User/Subscriber is eligible for the benefits of the respective Promotional offer . This provision shall apply and subject to change, at the sole discretion of mactel.ca, to all promotional offers whether they are signed up for by the customer directly with mactel.ca or through the mactel.ca's distribution partners or agents.

    7.2 All types of promotional campaign or offers involving a cash reward system will be credited into user's billing balance account/wallet, is meant for the purpose of deduction for future Service(s) usage charges and cannot be used for any other purpose. All the reward balances which will be left unused are subject to getting nullified on the cancellation date. Under this system, at any given time the reward balance cannot be cashed out via any method.

    7.3 mactel.ca reserves all the rights and final decision to determine when the promotional period or offer will/may end. (Example: promotional price will not be applicable for customer(s) moving to another location or shifting into a new service plan).

    7.4 Telecom service provider does not authorize or permit to any kind of transfer of users accounts to other people in any way. Strict and appropriate actions may be taken against your user account if you violate the terms and policies.

    7.5 mactel.ca reserves the right of final interpretation on all the terms of its promotion.

    8. Trial and Return Policy

    8.1 mactel.ca offers a 7 days 'Trial and Money Back Guarantee' on its IP Telephony Service(s).

    8.2 The 7 days trial period (the "Trial Period") starts from the date which the installation of your IP Telephony Service facilities has been successfully delivered and completed. The Seven days trial is counted from the day of your installation date, but not by any specific hours in which the actual installation was done. For any kind of service time exceeding six days, it will be counted as seven days.

    8.3 The seven days ‘Trial and Money Back Guarantee' is will be applicable and available only once at a specific address in conjunction with the purchase of our cable/fiber ATA, and/or ATA.

    8.4 If you are not satisfied with your purchase and wish to cancel the service within the 7 days trial, your ATA and monthly payment will be refunded upon the following terms, in addition to our existing policies:

    8.4.1mactel.ca receives the ATA and any other equipment(s) to be returned.

    8.4.2 Customers are obligated to pay for the shipping fees including shipping back fee.

    8.4.3 Any installation fee or activation fee already occurred is non-refundable.

    8.4.4 You may proceed to cancel by calling us.

    8.4.5 Within the seven days trial period, once you reach us out through our Call Centre facility and spoke to an Executive requesting the service cancellation, mactel.ca will start working on your refund for the charged amount within 30 business days after receiving your related documents and devices.

    8.5 No other fees for services, shipping, installation, or Equipment, are refundable even within the 7 days trial period. Where Equipment is defective as determined by mactel.ca and returned to mactel.ca not meeting our policy standards or parameters, the Equipment/Unit will be either repaired or exchanged at no cost, subject to the terms defined hereof.

    8.6 For all returns and exchanges, you will be responsible for placing the Equipment properly in the original product packaging, customer also need to make sure to include all accessories and other items originally provided by the manufacturer (including all manuals, paperwork and accessories) in the box. Customer will be solely responsible for the cost of any missing item/items as such, which shall be charged to your account. Current costs for such items are: ATA router -$60, Power Cable -$25, RJ45 cable- $10. Additionally, Customer is responsible for all return shipping charges when returning the Equipment/Unit or requesting a replacement Equipment/Unit.

    8.7 Once we receive the returned items(s); within thirty business days confirmation receipt and the refund will provided to your bank account or credit card or others (whichever is applicable)

    9. Usage

    9.1 You understand and agree that you will use the Service/Services in accordance with the instructions notified/shared to you on a regular basis without violating any applicable regulations and laws. You are solely responsible and will be held accountable for all usage and activity of the Service and for any kind of breaches, exploitation of this Agreement that may result. Any breach of security must be notified to us immediately. We shall have no accountability or liability for any damage or loss. You need to make sure that the Service is not used for any unlawful or fraudulent purposes by you or by anyone else otherwise you are responsible for all usage and charges on all devices registered in mactel.ca. You understand and agree to bear the risk of loss and assume all liability arising from any unauthorized, prohibited or fraudulent usage of the Service. Any such prohibited, fraudulent or unauthorized usage will be a complete material breach of this Term Agreement. You will be responsible to secure all credentials used to access the Service, including credentials used by telephones and other credentials used by administrators or end users, address of telephones, as well as the media access control (MAC)used by you. You will be responsible for paying for the Service or any other portion thereof on the premises that fraudulent calls and any other charges associated therewith comprised a corresponding portion of the Service.

    9.2 You must not use any automated means or tools to manipulate the Service or use the Service to violate any rule, regulation, law, or any third parties' personal rights or intellectual property. Additionally, you understand and agree that you will not use the Service nor allow others to use the Service for such purposes.

    9.3 to send a communication which is harmful, unlawful, threatening, defamatory, abusive, libellous, deceptive, obscene, harassing, offensive or racially or ethnically offensive, menacing or can be considered criminal in nature or if it is in breaching copyrighted contents, privacy or any other rights or in violation of something on similar line;

    9.4 Unless you have subscribed to a multiple mactel.ca login account, you should use only one login session per account at any given time. Your mactel.ca account is not transferable account and should be used only by the owner of household who has registered to use the account.

    9.5 Any account names or network addresses that are assigned to you shall remain our property at all times.

    9.6 We reserve the right to terminate this agreement, in connection with your breach of any terms of this Agreement or if you engage in one or more of the prohibited activities mentioned below.

    9.7 By making the purchase of the residential VoIP plan, you understand and agree not to use the Service directly or indirectly in any way that is beyond normal residential purpose usage. Any use of the Service(s) for commercial, professional, governmental or other activities, including but not limited to: home, business, sales, office, autodialing, fax broadcasting, telemarketing, or any other activities that would not represent residential or personal use, will be deemed as non-residential use. Such judgments will solely be at the discretion of mactel.ca, in which various factors may be taken into consideration including but not limited to: volumes, usage, volume of calls, high-rate special/premium services and/or personal prefixed numbers, the total number of destinations called per month, continuous dialling or calling activity, or any other factors that is not consistent with normal residential use.

    9.8 mactel.ca reserves the sole right to take necessary actions if your usage is deemed non-residential, including modification, notification, warning, disconnection, or termination of your service(s).

    9.9 If we determined that you have violated this agreement, we may:

    9.9.1 Issue a warning to you;

    9.9.2 Suspend your access to some or all features of the services;

    9.9.3 Terminate this Agreement;

    9.10 Additionally, if significant damages are incurred and/or any legal issues arises due to the improper usage in violation with this agreement, mactel.ca reserves the sole right to bill you for any kinds of direct or indirect cost incurred by the service provider, including any additional charges to enforce your compliance with our company.

    9.11 We may terminate this Agreement and your Service at any time for convenience upon giving you not less than thirty days' prior written notice without any liability. If the notice of termination is sent from our side for convenience no disconnection fees will charged.

    10. Support

    10.1 If the Equipment experiences malfunctions during its intended use, mactel.ca’s, at its sole discretion, will replace and maintain the Equipment if needed. In such an event, you agree that mactel.ca’s liability and your sole remedy will be limited to a refund of the charged amount or the replacement of such Unit(s)/Equipment by mactel.ca, provided that you notify mactel.ca as soon as possible upon Equipment malfunction. After determining whether that repair was not required or was required due to mis-use or damage caused by you, you agree to pay mactel.ca's cost necessary for such replacement or repair.

    10.2 Upon cancellation or termination of Services, you agree to return the Equipment(s), which is owned by mactel.ca, at your own expenditure. You will be responsible for paying the continuing service charges of the Unit(s)/Equipment until it is returned. In case you fail to return the Unit(s)/Equipment within the required time (Thirty days), mactel.cas may repossess the Unit(s)/Equipment at your expenditure, and/or may charge you for the cost of replacement of such Equipment.

    10.3 Compensation for interruption of service(s). There is absolutely no compensation or remedy for the interruption of servie(s) in the case of less than seven (7) days. mactel.ca has the sole discretion and reserves the right to make the final decision on the remedy compensation amount for the interruption of services in case service-interruption lasts more than seven (7) days. The refund amount (compensation amount) for internet service should not exceed more than your service payment amount. mactel.ca will only refund for those relevant internet service fees, such as, ATA, installation and monthly fee. mactel.ca reserves the right and will not refund any remedy which not related to mactel.ca internet service. mactel.ca does not take any responsibility for all of the costs incurred under any condition.

    11 Termination or Cancellation

    11.1 You may terminate any or all of your subscribed Service(s) at any time by contacting mactel.ca at the phone number, set out on the mactel.ca website at www.mactel.ca, and speaking with a mactel.ca Team Member.

    11.1 At the time of termination, if your account has a credit balance over $10 in it then we will refund the balance amount to you within sixty days period from the date of termination. (Note: Promotional credit Balance wont be counted). If the Service(s) is cancelled/terminated by either party, in this case the applicable charges will continue to apply until the date of the notice or a particular future date specified therein (if applicable), whichever is later.

    11.1 c. The entire credit balance amount applicable will be refunded back to the debit/credit/prepaid card that the customer paid from (i.e. Original source of payment). No other form (e-transfer/PayPal/cheque) is applicable.

    11.1 d. Cancellation or plan changing request must be communicated to our call centre department over a phone call. mactel.ca may suspend or terminate the service without any notice

    11.2 Your service might be suspended without any notice when there is no payment by due dates in this time you may lose your phone number. mactel.ca DOES NOT GUARANTEE

    11.3 mactel.ca may cancel or terminate any or all of your Services or accounts upon no less than thirty days' advance notice period to you at your billing address, which may be an email address or postal address provided by you to mactel.ca for billing purposes.

    11.4 We may suspend, block or terminate any or all of your Services or the User Accounts in any way, without any notice or liability, if

    a. You fail to pay the invoice; b. You violate or disagree our policy, terms, or conditions; c. You harass, threaten or abuse mactel.ca, its Service (s), our employees and/or agents; d. You fail to pay the invoice; e. You are willingly not to cooperating with our troubleshooting procedure. f. If you violate any of the terms clearly mentioned in Section 9 and Section 12

    12. Acceptable Use Policies

    12.1 The Subscriber is solely responsible for using the Services by itself or friends or family or any other person with our without your knowledge (collectively, the "End Users"). The Subscriber/Customer/user agrees to fully comply and to make sure that the End Users will comply with the following procedures and policies associated with the Services' usage.

    12.1 Rules While using the Service, you may not:

    12.1.1 post, transmit, distribute information that constitutes a criminal offense.

    12.1.2 post or transmit messages constituting "spam," which includes but is not limited to unsolicited calls or false commercial messages. It is customer's sole responsibility to make sure that your Internet service provider (ISP) meets the basic requirements stated being necessary to use the MacTec.ca Service.

    12.1.3 mactel.ca will not assume any responsibility for your acts or commissions any individual who uses your account.

    12.2 Monitoring

    mactel.ca has no obligation or any compulsion to monitor the Service (s). However, in order to protect its subscribers and itself, mactel.ca will be entitled to monitor the Service electronically on a regular basis and disclose/share any information/data concerning the End User required by the Subscriber or it might be necessary to meet the requirements of any regulation, law or lawful request or as necessary to operate or functioning of the Service or to protect itself or others. mactel.ca will not intentionally monitor or disclose any private information or email message(s) unless required by law. mactel.ca reserves the exclusive right to refuse or decline any requests to post, or to remove any information or materials or other contents, in whole or partially, that it determines and concludes in its sole discretion, are undesirable, unacceptable, or in violation of these Term policies.

    12.3 Intellectual Property

    All copyright, trademarks, brand concepts, logos, names ,designs and other contents used by us are intellectual property assets, registered, non-registered or otherwise, of, or used under license by Alpha Televoice Ltd, the parent company of MacTec.ca. All of these are recognized and categorised as valuable assets/properties of their respective owners, and they may not be used or displayed by you in any manner for commercial or other purposes or copied or replicated in any way for any purpose without the written permission and consent of Alpha Televoice Ltd that owns it. Alpha Televoice Ltd reserves the exclusive right to remove or withdraw the credit or terminate the account if we detect any involvement of trademark and copyright violations without any notice or liability to you.

    13. Service Changes and Amendments to the Agreement

    From time to time, We may update or change the terms and conditions of this Agreement. The Notices will be considered given and effective on the date posted/mentioned on www.mactel.ca. Such changes(minor or major) will become binding on you on the date they are posted to our website, without any further notice from our side is required upon your continued usage of the Service. The Term Agreement as and when posted supersedes all previously understood and agreed to written and electronic terms of Service, including, but not limited to, any terms included with the packaging material or paperwork inside the box of the Device and also supersedes any written terms shared to Retail Customers in connection with retail distribution, including, not limited to, any written terms enclosed within the packaging of the Device.
